3. Collection and Storage of Personal Data, Manner and Purpose of their Use


a) When Accessing the Website

If you are accessing our website www.hm-ra.com,
information will automatically be sent to the server of our website because of the browser installed at your end device.
This information will be temporarily saved into a so-called log-file. Without you being able to influence this process,
the following information will be gathered and saved until the automatic deletion:


  • IP-address of the requesting data processor,
  • date and time of the access,
  • name and URL of the retrieved file,
  • website from which the access is effected (referrer-URL),
  • used browser and, if applicable, the system software of your data processor as well as the name of your access provider.




We will use the mentioned data for the following purposes:

  • safeguarding an unobstructed dial-up to the website,
  • safeguarding a comfortable usage of our website,
  • evaluation of the system security and stability as well as
  • for further administrative purposes.



The legal basis for the data processing is Art. 6 Sec. 1 S. 1 lit. f GDPR.
Our legitimate interest follows from the abovementioned purposes of the data collection. In no case will we use the collected data for the purpose of drawing conclusions regarding your person.
In addition to this, we make use of cookies as well as of analyzing services when accessing our website.
You will receive further explanations of this process under Sec. 4 and 5 of this Data Protection Statement.



b) When Using our Contact Form



If you have any kind of questions, we offer you the possibility to contact us by means of a form which we provide on our website. This requires the statement of a valid e-mail address so that we are able to identify the one making the request and to answer it appropriately. Further statements may be made voluntarily. The data processing for the purpose of getting into contact with us is effected pursuant to Art. 6 Sec. 1 S. 1 lit. a GDPR on the basis of your voluntarily given consent. The personal data collected by us for the purpose of using the contact form will automatically be deleted after the handling of your request.




4. Transmission of Data to Third Parties


There will be no transmission of your personal data to third parties except for the purposes
mentioned below.
We will only transmit your personal data to third parties:



  • if you have explicitly consented to such a transmission pursuant to Art. 6 Sec. 1 S. 1 lit. a GDPR,
  • if the transmission is necessary pursuant to Art. Sec. 1 S. 1 lit. f GDPR for the purpose of the establishment, exercise and defence of legal claims and there is no basis for the assumption that you have got a predominant and protectable interest in the non- transmission of your data,
  • in the case that there exists a statutory obligation regarding the transmission pursuant to Art. 6 Sec. 1 S. 1 lit. c GDPR, as well as
  • if this is statutorily permitted and if it is necessary according to Art. 6 Sec. 1 S. 1 lit. b GDPR regarding the performance of contractual relationships with you.




5. Cookies


We use cookies on our website. These are little data sets your browser creates
automatically which are saved onto your end device (laptop, tablet, smartphone or else)
if you access our site. Cookies do not cause any damage on your end device, contain no
viruses, Trojans or other malicious software.
The cookie archives information that is generated dependent on the respective end device
used in the specific case. This does, however, not imply that we receive immediate
knowledge of your identity.
On the one hand, the use of cookies serves the purpose of making the usage of our offer
more comfortable for you. Thus, we use so-called session-cookies in order to perceive
that you have already accessed individual pages of our website. These will automatically
be deleted after leaving our website.
Moreover, also in order to optimize the user-friendliness, we make use of temporary
cookies which are saved on your end-device for a certain fixed period. If you access our
site again in order to make use of our services, there will be an automatic recognition
that you have already been with us and which inputs and calibrations you have already
made, so that you do not have to employ these for another time.
On the other hand, we use cookies in order to statistically measure the use of our
website and to optimize our offer for you (cf. Sec. 5). In case you access our website
again, these cookies enable us to automatically recognize that you have already been
with us. These cookies will be automatically deleted after a respectively defined time-limit.
The data processed by means of cookies are necessary for the mentioned purposes in order
to safeguard our legitimate interests as well as the ones of third parties pursuant to Art. 6 Sec. 1 S. 1 lit. f GDPR.
Most browsers automatically accept cookies. You may, however, configure your browser in
such a way that no cookies are saved on your computer or that there will always be a
hint before a new cookie is installed. The complete deactivation of cookies may,
however, entail that you are not able to use all functions of our website.




6. Data Subject Rights


You have got the right:

  • to request information about your personal data processed by us (Art. 15 GDPR). You may especially request information about the purposes of processing, the categories of the personal data, the categories of recipients whom your personal data have been or will be disclosed to, the envisaged period for which the personal data will be stored, the existence of a right to rectification, deletion, restriction of processing or objection, the right to lodge a complaint, the source of your data if those have not been collected by us as well as about the existence of an automatized decision-making including profiling and, if applicable, meaningful information as to its details;
  • to request immediate rectification of inaccurate personal data or completion of your personal data stored with us (Art. 16 GDPR);
  • • to request deletion of your personal data stored with us unless the processing is necessary for exercising the right of freedom of expression and information, for the compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of a legal claim (Art. 17 GDPR);
  • to request the restriction of the processing of your personal data if you contest the accuracy of the data, if the processing is unlawful but you still object to the deletion of the personal data and if we no longer need the data but you still require those for the establishment, exercise or defence of legal claims or if you have objected to the processing according to Art. 21 GDPR (Art. 18 GDPR);
  • to receive your personal data which you have provided to us in a structured, commonly used and machine-readable format or to request the transmission to another controller (Art. 20 GDPR);
  • to withdraw your consent at any time (Art. 7 Sec. 3 GDPR). This entails that, thereafter, we are no longer allowed to continue with the data processing based on such consent and
  • • to lodge a complaint with a supervisory authority (Art. 77 GDPR). In order to do so, you can generally turn to the supervisory authority at your habitual place of residence or place of work or at our law firm’s registered business address.



  • 7. Right to Object


    If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 Sec. 1 S. 1 lit. f GDPR, you have got the right to object against the processing of your personal data (Art. 21 GDPR) on grounds of your particular situation or if the objection is directed against direct advertising. In the last case you have got a general right to object which will be implemented by us without the necessity of stating a particular situation.     8. Data Security


    Within the website access we use the prevalent SSL-procedure (Secure Socket Layer) together with the respectively highest encryption supported by your browser. Usually this is a 256 bit encryption. If your browser does not support a 256-bit encryption we recur to 128-bit v3 technology instead. You will notice whether or not a single page of our website is transmitted cryptographically secured by the locked presentation of the key or, respectively, the closed lock in the lower status bar of your browser. In addition to this, we make use of suitable technical and organisational security measures in order to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against the unauthorized access by third parties. Our security measures are continuously improved in accordance with the technological development.




    9. Up-to-Datedness and Modification of this Data Protection Declaration


    This Data Protection Declaration is currently up-to-date and is dated May 2018. Due to the further development of our website and related offers or due to changed statutory or administrative demands it might become necessary to modify this Data Protection Declaration.
